WHEREAS, pursuant to Act 925 of the Regular Session of the 2008 Louisiana Legislature, the Mid-City Security District, (hereinafter referred to as the “District”), a political subdivision of the state, was created; and

WHEREAS, the aforesaid Act authorized the New Orleans City Council to levy and collect a parcel fee on all parcels within the District after the imposition of such fee had been submitted to, and approved by the majority of the voters of the District voting on the question at the same time as the Presidential Election held in the city; and

WHEREAS, an election was held on November 4, 2008 at which a majority of the voters of the District voted on the issue, voted to impose the parcel fee in the amount of $200.00 not to exceed $250.00 for residential parcels and $300.00 not to exceed $375 for commercial parcels for seven years on each parcel located in the District; and

WHEREAS, the Board of Commissioners of the Mid-City Security District (the Board), desires that the City Council of New Orleans levy and collect such a parcel fee of $200.00 for residential parcels and $300 for commercial parcels on each parcel within the District, and add such fee to the property tax bills to be issued by the City of New Orleans to the owners of the property within the District and subject to the fee for the tax year commencing 2009; and

WHEREAS, in connection with the City Council’s levy and collection of the aforesaid $200.00 or $300.00 parcel fee, it being necessary and proper that the Board first adopt a plan and a budget of revenue and expenditures for 2009 which indicate how the proceeds for the aforesaid $200.00 or $300.00 parcel fees will be expended for the purpose of providing for an increase in the presence of law enforcement personnel in the District;

NOW THEREFORE,

Be it resolved by the Board of Commissioners of the Mid-City Security District, that the following plan and budget of revenue and expenditures for 2009 which indicate how the proceeds for the aforesaid $200.00 or $300.00 parcel fee will be expended for the purpose of providing for an increase in the presence of law enforcement personnel in the District, be and the same is adopted.

I.Plan

The District plans to provide security patrols within the District. The estimated annual cost of providing such services is $864,464 to be spent as follows:

The District anticipates receipts on parcels of taxable property for the tax year 2009 at $891,200; therefore, the 2009 budget is as follows.

BE IT FURTHER RESOLVED that the city council of the City of New Orleans is hereby requested to collect and levy the $200.00 parcel fee for residential parcels and $300 parcel fee for commercial parcels approved by the voters of the Mid-City Security District (the District) on November 4th, 2008, and to include said fee in the property tax bills to be issued by the City of New Orleans to owners of the parcels within the District and subject to the aforesaid parcel fee for the tax year commencing 2009.
